As expected, a plaintiffs' lawyer-backed bill to undo last year's California Supreme Court ruling in Howell v. Hamilton Meats has been introduced by Senate President Pro Tempore Darrell Steinberg (D-Sacramento).

Last week CJAC held its final two Civil Justice Leadership Award luncheons after presenting our first two awards the week prior. On Wednesday, December 7th, we headed to Tustin in Orange County to present an award to Assemblymember Don Wagner (R-Irvine), who represents the 70th Assembly District. As mentioned previously, Wagner received the award for being a consistent, strong voice for civil justice reform as Vice-Chair of the Assembly Judiciary Committee, which hears hundreds of bills each year that impact the civil justice system.

This week CJAC held its first two luncheons to present our 2011 Civil Justice Leadership Awards. On Tuesday we presented an award to Senator Lou Correa in Anaheim with over 30 guests in attendance (Correa is pictured here with CJAC Legislative Director Katherine Pettibone on the left and President Kim Stone on the right.) IMG_5642.JPGHe received the award for being a strong ally against legislation that would increase unwarranted lawsuits and for authoring SB 883, which unfortunately did not pass but would have established immunity for employers who rely in good faith on the rules of the Department of Labor Standards Enforcement.

Governor Jerry Brown had until the end of Sunday to sign or veto bills introduced this year in the Legislature, and so we've now come to the end of the first year of the two-year legislative cycle. With a new Democratic Administration at the helm going into 2011, there was great uncertainty over what this Legislature and Governor would do after six years of a Republican Administration.

We are pleased to announce that Assembly Bill 1074, authored by Felipe Fuentes (D-Los Angeles), was signed into law today by Governor Brown. CJAC has supported the bill since its introduction this year, as it would provide non-traditional communication providers the same civil liability protection given to traditional telephone companies in providing 9-1-1 support services. Current law protects phone companies from ordinary negligence claims when providing service for 9-1-1 calls originating from landlines, but 9-1-1 calls made through the Internet or digital technology do not have the same civil liability protections.

The California Legislature wrapped up its 2011 session in the very early hours of Saturday morning. Supporters of civil justice reform will be pleased to know that CJAC had a great deal of success this year.

Yesterday Assemblyman Mike Feuer (D-Los Angeles) announced that he would not be moving forward with Assembly Bill 52 this year due to a lack of support in the State Senate. We are extremely pleased that legislators have recognized the major flaws of this proposal.

Check out the column by Jon Entine of George Mason University that ran on the Huffington Post earlier this month that explains how proposals to essentially ban the plastic additive bisphenol A (BPA) are at odds with the science on the issue.

The Sacramento Bee reported this week that the California Environmental Protection Agency will move forward with the installation of additional automated external defibrillators (AEDs) at its headquarters in Sacramento after an employee suffered cardiac arrest last week and a union grievance was filed.
