A major California Supreme Court ruling was issued yesterday in which the Court found that plaintiffs who lose disabled access lawsuits are liable for the defendant's attorney's fees.

We regret to report that the ADA reform measure joint-authored by Senate President Pro Tem Darrell Steinberg and Senator Bob Dutton - SB 1186 - has been significantly weakened in the latest round of amendments, which were made yesterday.

We are happy to report that Senate Bill 1186, joint-authored by Senate President Pro Tem Darrell Steinberg and Senator Bob Dutton, was passed by the State Senate yesterday on a 36-0 vote.

There is no shortage of proposals in the California Legislature this year to change the way the Americans with Disabilities Act (ADA) is enforced in our state, a reflection of the fact that the problem of abusive ADA lawsuits is not getting any better.

CJAC President Kim Stone will be hosting an Americans with Disabilities Act (ADA) workshop tomorrow in East San Diego County in the town of Lakeside. The event will be co-hosted by the Lakeside and Santee Chambers of Commerce and State Senator Joel Anderson. The workshop will be from 7:30-9:00 a.m. at Café 67 in Lakeside.

A new push to reduce ADA lawsuits has emerged in a city that has always proven to be unafraid of fighting for change. San Francisco Supervisor David Chiu recently introduced an ordinance to give priority for construction permits that would bring businesses into compliance with disabled access laws, would mandate that commercial landlords make tenants signing or renewing a lease aware of potential ADA issues, and would allow small self-service restaurants and retail coffee stores to exclude the square footage of floor area required for disabled access from the calculation of maximum allowable square footage.

This week the California Citizens Against Lawsuit Abuse (CALA) released a new report summarizing the roundtable discussions they held across the state in which they brought together local elected officials, community leaders and business owners to share different perspectives about how excessive litigation is hurting California and what can be done to stop it.

A new proposal has been introduced in Congress, H.R. 3356, to give business owners a brief period of time to make ADA fixes before they can be sued. Congressman Dan Lungren (R-Gold River), from the Sacramento region, recognizes how vulnerable small businesses are to an exploitative lawsuit, and wants to give business owners 120 days to get their facilities in compliance after they have been notified of alleged violations.

Yesterday CJAC President Kim Stone continued our Americans with Disabilities Act (ADA) seminars, this one hosted by State Senator Joel Anderson and the Poway, CA Chamber of Commerce. CJAC has held a number of seminars in recent years across California to help small business owners understand the importance of complying with ADA to avoid a costly lawsuit. The ADA rules can get very complicated and it can be difficult to know if you're in compliance. When you combine that with the fact that there are serial plaintiffs out there, as we often point out, abusing the law to force settlement payments regardless of whether the fixes are made, business owners must be diligent when it comes to disabled access.

Check out this post on the San Francisco Chronicle's Hot Topics blog: White Castle sued by overweight burger-lover. An obese New Yorker has claimed that his civil rights have been violated because he cannot fit into the booths at White Castle restaurants. We're going to have to put this one in the "excessive and unwarranted" category...
