Day At the Capitol is Around the Corner

Tom Scott, Executive Director of Citizens Against Lawsuit Abuse, recently announced that the CJAC/CALA Day at the Capitol will take place on March 19th, 2014. The annual event invites Californians to Sacramento to talk with their legislators about the various types of lawsuit abuses that they have faced while living in the nation's worse "Judicial Hellhole."

CJAC Talks with NBC Bay Area About Frivolous ADA Lawsuits

The Bay Area NBC Investigative Unit revealed that California is home to the largest number of Americans with Disabilities lawsuit filings in the nation from 2005-2013. Not only does California outpace the rest of the nation, it has more lawsuits per 100 thousand disabled than the next four states combined.

Kim Stone recently sat down with the Investigative Unit to discuss the types of frivolous ADA lawsuits that are straining local businesses.

LRANY Releases Frivolous Lawsuit Generator App

Media reports of outlandish or ridiculous lawsuits have become increasingly common, spurring renewed calls for legal reform. To highlight the issue, the nonprofit Lawsuit Reform Alliance of New York (LRANY) has launched a new app which allows users to generate their own fictional frivolous lawsuits.

While the app is just for fun, the creators hope it highlights the serious issue of frivolous lawsuits and lawsuit abuse. “We felt that using humor to show people how silly lawsuits can be was a good approach to increase public awareness of frivolous lawsuits,” said Tom Stebbins, Executive Director of LRANY. “We hope this app will educate people on the problem, and more importantly, some of the solutions.”

CJAC Remains Perfect as Bills Head to Governor's Desk

With the close of the legislative season, we are pleased to report that 34 of the 34 bills we opposed at the start of the session have already been stopped or adequately amended. Additionally, we have nine supported bills awaiting the Governor's approval.

We've had a number of significant victories during the legislative year. CJAC opposed and helped to defeat AB 458 by Assemblymember Bob Wieckowski (D-Fremont), which would have repealed existing law allowing businesses a tax deduction for punitive damages paid or incurred in connection with a judgment or settlement.

We also adequately ammended AB 325 by Assemblymember Luis Alejo (D-Salinas), which would have significantly expanded the statute of limitations in lawsuits over local government land-use decisions and increased lawsuits challenging land-use planning decisions.

Meanwhile, CJAC helped to send three "Good Samaritan" bills through the legislature and to the Governor's desk. AB 633 (Salas), SB 669 (Huff), and AB 635 (Ammiano) all seek to protect "Good Samaritans" who are acting in good faith and with reasonable care from frivolous lawsuits as a result of their actions. Governor Brown has until October 13, 2013 to veto these bills or they will become law.
